USCIS Processing Delays and Our New Annual Case Administration Fee
Why We Are Adding an Annual Case Administration Fee
At Delgado Law Firm, we understand how important your immigration case is to you and your family. When you hire our firm, our legal team works hard to prepare your case correctly, gather the necessary evidence, meet deadlines, and properly file your case with USCIS.
Once your case is filed, however, we cannot control how quickly USCIS makes a decision.
Recently, there have been significant changes in immigration policies and USCIS procedures. We are also seeing many cases remain pending longer than expected and what we have seen in the past. USCIS’s policy and operational changes under the current administration have resulted in delays in processing times.
In many situations, our clients and our legal team have done everything required, but the case continues to sit with USCIS waiting for a decision.
What Types of Cases Are We Talking About?
The annual fee may apply to USCIS cases that remain pending for an extended period of time, including:
• Family petitions and marriage-based cases
• Adjustment of Status/Green Card cases
• Naturalization
• Waiver cases, including I-601 and I-601A waivers
• VAWA and other humanitarian immigration cases
• U Visa and T Visa cases
• Removal of Conditions cases (I-751)
Your Case Is Still Active With Our Office
Even while we are waiting for USCIS, your case does not simply disappear from our office.
We continue to maintain your file, receive and review USCIS notices, keep track of important deadlines, maintain your information in our case-management system, monitor your case with USCIS, and stay informed about immigration changes that may affect your case.
When a case remains pending for an additional year—or sometimes several years—our office continues to be responsible for maintaining that case throughout that time.
What Is the Annual Case Administration Fee?
Because many USCIS cases are remaining pending for extended periods of time, Delgado Law Firm is implementing an Annual Case Administration Fee for certain cases that remain pending with USCIS.
This fee is not a penalty. It does not mean something is wrong with your case, and it does not mean that you did anything wrong.
The fee helps cover the ongoing cost of keeping your case active and properly maintained while we wait for USCIS to make a decision.
We know it can be frustrating when you have provided everything requested, our legal team has properly prepared and filed your case, and everyone is simply waiting for the government to take the next step.
Our work and responsibility to our clients continue while we wait. We appreciate your patience, understanding, and continued trust in Delgado Law Firm.
